Unlike the initial filing fee — where individuals and MSMEs pay ₹4,500 and companies pay ₹9,000 per class — the renewal fee under Trade Marks Rules 2017 First Schedule is ₹9,000 per class for all applicant types. When to Renew Your Trademark

Your trademark is valid for 10 years from the date of filing the original application — not from the date the registration certificate was issued. This is a common source of confusion. Late Renewal — What It Costs

If you miss the renewal deadline, you have a 6-month grace period during which you can renew with a late surcharge. The late renewal surcharge is ₹4,500 per class in addition to the standard ₹9,000 renewal fee — making the total late renewal cost ₹13,500 per class for e-filing.

Restoration After Removal — The Most Expensive Option

After the 6-month grace period expires, the trademark is removed from the Trade Marks Register. Once removed, it becomes available for registration by anyone — including your competitors. To recover your trademark, you must file for Restoration using Form TM-13 under Rule 73 of the Trade Marks Rules 2017. The restoration cost is:

  • Restoration fee (Form TM-13): ₹9,000 per class
  • Renewal fee (Form TM-R): ₹9,000 per class
  • Total restoration cost: ₹18,000 per class

Warning: Restoration is not guaranteed. The Registrar has discretion to reject a restoration application. If restoration is rejected, you must file a completely new trademark application at the current government fee (₹4,500 or ₹9,000 per class) and restart the entire 12–18 month registration process. You also risk finding that a competitor has already filed for your mark during the removal period.

From what date is the 10-year trademark validity calculated?

Trademark validity in India is calculated from the date of filing the original application — not from the date the registration certificate was issued.
