Why Exclusively IP Matters
A generalist advocate who handles trademark filings alongside other legal work approaches trademark prosecution differently from a specialist. In our experience, three patterns appear when trademark filings are handled by generalists:
First, examination reports are underestimated. A generalist may send a templated reply that does not engage with the specific legal grounds in the report — a Section 11 relative grounds objection requires factual and legal arguments distinguishing the marks, not a standard paragraph. A poor examination reply results in a hearing; a poor hearing results in refusal; a refused application loses the government fee with no recourse.
Second, class selection is often wrong or over-inclusive. Filing in unnecessary classes wastes ₹4,500–₹9,000 per class in government fees. Filing in insufficient classes leaves protection gaps that a competitor can exploit. Correct class selection requires understanding both the client’s business and the NICE Classification system — knowledge that a specialist develops through daily practice.
Third, renewal dates are missed. Trademark renewal is due 10 years from the filing date. Without a systematic tracking system, clients — and generalist attorneys — forget. A missed renewal that goes past the 6-month grace period permanently removes the trademark from the Register at the cost of ₹18,000 per class for restoration — if restoration is even granted.
Our Approach — Search First, File Smart
Legismith never files without first conducting a trademark availability search. Before every new filing, we run two searches:
- Section 9 analysis (absolute grounds): We assess whether the proposed mark is distinctive or whether it will face objections as descriptive, generic, or deceptive. If the mark is likely to face absolute grounds objections, we advise the client before filing — saving the government fee on a mark that will likely be refused.
- Section 11 analysis (relative grounds): We search the Trade Marks Registry database for identical or deceptively similar marks in the same and related classes. If a conflicting mark exists, we advise on strategies to differentiate the marks or consider alternative brand names before investing in filing fees.
After filing, we use the LEGIDESK trademark management platform to track application status, examination report issuance, hearing dates, journal publication, registration certificate issuance, and renewal deadlines. Transparent Pricing — One Flat Fee, No Surprises
Legismith charges a single flat professional fee of ₹20,000 for trademark filing through registration — including search, filing, examination report reply, and hearing representation. Government fees paid to IP India (₹4,500 per class for individuals/MSMEs/startups, ₹9,000 per class for companies/LLPs) are billed in addition at cost. 18% GST applies to the professional fee only.
Total investment: ₹24,500 plus GST (₹28,100 inclusive) for individuals and MSMEs filing one class. ₹29,000 plus GST (₹32,600 inclusive) for companies and LLPs filing one class. Each additional class adds the respective government fee. No hidden charges. No surprise invoices at the examination stage. No separate hearing fee.
